Terms and Conditions

Plain‑English summary (not legal advice): This page explains how we provide notary services, what you agree to when booking with us, and the limits required by Florida law. Please read carefully and contact us with any questions.

1) Who we are

These Terms & Conditions (the “Terms”) govern your use of the website and any scheduling or notarial services offered by In-depth Notary Services, LLC (“we,” “us,” or “our”). Our principal place of business is Clearwater, Florida. Contact: +1 (727) 692-1131 • info@in-depthnotary.com

 

2) Not legal advice / no attorney‑client relationship

We are commissioned Florida Notaries Public. We are not attorneys and do not give legal advice. Nothing on this site or in our communications should be taken as legal advice. If you need legal advice, consult a licensed attorney.

If we advertise services in a language other than English, we will include the required notice: “I am not an attorney licensed to practice law in the State of Florida, and I may not give legal advice or accept fees for legal advice.”

 

3) Scope of services

We perform traditional in‑person notarizations and, if requested and available, Remote Online Notarization (RON) for eligible documents and signers. We do not draft documents, select forms, or decide whether a document is appropriate for your situation. You are responsible for ensuring your document is complete and acceptable to the receiving party (court, agency, or business).

 

4) Your responsibilities

By booking or requesting service, you confirm that:

  • You will present a valid, acceptable government photo ID and personally appear (in person or online) for the notarial act.

  • The document is complete (no blank spaces to be filled later) and you understand what you are signing.

  • You will sign only in the notary’s presence and follow all notarial instructions.

  • For RON, you have the technology and connectivity needed to complete identity proofing, credential analysis, and live audio‑video communication.

We reserve the right to refuse service if any requirement of law or these Terms is not met (examples include lack of proper ID; apparent incapacity or duress; document incompleteness; or if the signer does not personally appear).

 

5) Identification requirements (summary)

For in‑person notarizations, acceptable IDs typically include a current (or issued within 5 years) government‑issued photo ID (e.g., driver license, state ID, U.S. passport; certain foreign passports; U.S. military ID; etc.). For RON, identity proofing and credential analysis are required; additional rules apply. We may allow credible witnesses when permitted by law. See our FAQ or ask us for details.

 

6) Remote Online Notarization (RON) consent & recording

If you choose RON, you consent to:

  • Completing knowledge‑based identity proofing (KBA) and credential analysis.

  • The entire session being audio‑video recorded and securely retained for the statutory period.

  • Secure electronic journaling of the notarial act.

You acknowledge that platform/KBA attempts may fail due to third‑party data limits or mismatches. Additional attempts may incur additional costs from the platform or data provider. We cannot control your internet, device, or third‑party system performance.

 

7) Fees and payment

  • Traditional In-person notarial acts: We charge up to the statutory maximum per notarial act. $10.00.

  • Remote Online Notarization: Up to the statutory maximum per online notarial act. $25.00.

  • Travel / mobile service fees: If we travel to you, we may charge reasonable travel, waiting‑time, parking, or after‑hours fees separate from the notarial fee.

  • Platform / processing fees: Third‑party RON platform fees and identity‑proofing costs may be charged separately where permitted.

  • Witness services: If you request us to arrange witnesses, additional fees apply. $10.00. You may provide your own qualified witnesses to avoid these fees.

  • Courier / shipping / printing / translation: Ancillary service fees (e.g., document printing, courier, translations) may be charged separately.

All fees will be disclosed before service is performed. Payment is due at booking or at the appointment unless otherwise agreed in writing.

 

8) Scheduling, cancellations, and refunds

  • Rescheduling: You may reschedule once without penalty if you give at least 2 hours notice.

  • Cancellations: If you cancel less than 2 hours before the appointment or fail to appear, we may retain a nonrefundable booking fee of $20 to cover reserved time and platform costs.

  • Failed RON due to KBA/credential analysis: If identity proofing fails after two attempts, we may (a) refund the notarial fee only and (b) retain platform/KBA charges actually incurred.

  • Refunds are not available for notarial acts completed in compliance with law.

 

9) No guarantee of acceptance by a third party

Different institutions have different policies about notarized documents (especially those notarized online). We do not guarantee that a receiving party will accept a particular notarization. You are responsible for confirming acceptance with the recipient in advance.

 

10) Privacy, data security, and records

We handle your personal information consistent with applicable law. For RON, the session is recorded and the related electronic journal entry is maintained for the statutory period. Access to copies of the electronic journal entry and the RON recording is limited by law to specific persons and circumstances. We may charge the statutory fee to provide copies when allowed. 11) Prohibited and limited acts (examples)

We will not:

  • Notarize if the signer does not personally appear (physically or via authorized audio‑video technology) or appears unaware of the document’s nature.

  • Notarize incomplete documents (blanks to be filled later) or if we suspect fraud, coercion, or duress.

  • Provide legal advice, select forms, or explain your legal rights.

 

12) Electronic communications & e‑sign consent

By using the website, scheduling, or completing a RON session, you consent to receive electronic communications and to electronically sign and receive records related to your transaction. You may withdraw consent by contacting us, but doing so may delay or prevent service.

 

13) Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to a notarial act or the services provided under these Terms is limited to the total fees you paid to us for that specific transaction. We do not exclude liability for gross negligence, willful misconduct, or where otherwise prohibited by law.

 

14) Indemnification

You agree to indemnify and hold us harmless from claims, losses, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of our services, except to the extent caused by our gross negligence or willful misconduct.

 

15) Governing law & venue

These Terms are governed by Florida law. Venue for any dispute shall lie in the state courts located in Pinellas County, Florida, unless federal jurisdiction applies.

 

16) Changes to these Terms

We may update these Terms from time to time. Changes are effective when posted to this page with a revised “Effective date.”
