Getting Prepared Before the Notary Arrives
Often times a family member, relative or friend will make an appointment on behalf of the patient. Here are a few things you should know before booking a notary service for the hospital patient.
-
Is the patient informed and agrees to the notarization of the specific document or documents.
-
Make sure signer has proper government-issued identification. (Ex. Drivers License)
-
Notaries can only notarize documents for patients who are coherent and not under heavy medication.
-
A best practice is to schedule appointments when the patient is most likely to be alert and not scheduled for labs, doctors’ visits, or during dinner hours etc.
-
Does the document require witnesses? Review the documents to be notarized to determine if additional witnesses are required. If witnesses are required, please let your notary know that they will be there for the scheduled appointment time.
If you have further notary questions about the process, please give us a call.

Guidelines for Notarizing Documents at Hospitals or Assisted Living Facilities
When notarizing documents in a hospital setting, it's essential for both the patient and their loved ones to understand a few key guidelines to ensure everything is done correctly and legally.

1. Proper Identification:
As a notary, my primary responsibility is to confirm the identity of the person signing the documents. This means the patient must have valid identification, like a driver's license or passport. If they don’t have an ID, there might be other ways to verify their identity, but proper identification is crucial.

2. Awareness and Willingness:
It's vital that the patient fully understands what they are signing. This is known as "being aware" or "having the capacity to understand." I need to ensure that the patient is not under any influence, such as heavy medication, that might impair their judgment. Additionally, the patient must be signing the document willingly, without any pressure from others.

3. Best Times for Notarizing:
Hospitals can be stressful environments, so choosing the right time to notarize is important. Typically, mid-morning or early afternoon are the best times. These are usually when patients are more alert, rested, and not yet too fatigued from the day. It’s best to avoid notarizing early in the morning, late at night, or right after a patient has had a medical procedure or taken medication that could affect their cognitive abilities.
4. Notary’s Role and Responsibility:
As a notary, I am a neutral third party. My job is not to advise on the contents of the document but to ensure the signing process is fair, legal, and properly witnessed. This includes making sure the patient is in a sound state of mind and free from any external pressures.
By following these guidelines, we can ensure that the notarization process in a hospital setting is smooth, legal, and in the best interest of the patient.
